Appeal of the Israeli Action Committee for the Palestinian Prisoners and Detainees

The Committee is an Israeli organization, which firmly believes that there can be no peace between Israel and Palestine so long as thousands of Palestinian so-called “security prisoners” and hundreds of administrative detainees continue to be held in Israeli prisons.

Members of the Committee believe that the Palestinian prisoners can and should play a significant role in advancing the peace process and in spreading the message that co-existence in the Middle East is indeed possible - but only if Israeli society pays attention to their hardships and puts an end to the systematic institutional discrimination against them - which exists first at the judicial level, and later on with regard to their imprisonment conditions and parole opportunities.

Members of the Committee are in close contact with a significant number of long-serving Palestinian prisoners, imprisoned even before the signing of the Oslo Accords, who strongly believe in a peaceful solution to the Israeli-Palestinian conflict.

Therefore,

The committee members have made it their goal to:

· Work to change the existing norm, whereby parole boards routinely deny parole to long-serving Palestinian “security prisoners” after they finish serving two-thirds of their sentence;

· Act towards commuting the sentences of long-serving prisoners, especially those whose cases the government of Israel refuses to even discuss with the Palestinian Authority (e.g., prisoners who hold Israeli citizenship);

· Advance a public discussion within Israeli society regarding the problem of the Palestinian prisoners, raising public awareness to their cause;

· Bring about a change in the incarceration conditions of those classified as “security prisoners,” equating them to those of other prisoners.

In order to achieve these goals, the Committee is already operating, and will continue to operate, both in the public and the legal arenas. In its first year of activity, the Committee aims to represent several Palestinian “security prisoners” who have already spent over 15 years in jail. The Committee will ask, on their behalf, that their sentences be commuted, and will represent them in parole board hearings. In addition, the Committee intends to launch a public campaign, which will include writing newspaper articles and holding at least one academic conference on the subject.

In order to advance its activities, the Committee needs some financial support. A large part of the activity is done by volunteers, yet the expenses involved in legal representation demand resources. The Committee’s legal dealings are coordinated by Adv. Michael Sfard of Tel Aviv.

Please help us achieve the goals we have set for ourselves. Please distribute this appeal as widely as possible, write letters and articles about the problem of the Palestinian prisoners, and also, please help us cover the expenses of our activities.

קול קורא: ועד הפעולה הישראלי למען אסירים ועצירים פלסטינים

הוועד הוא ארגון ישראלי המאמין שלא יתכן שלום בין ישראל ופלסטין ללא פתרון לבעיית אלפי האסירים המסווגים כביטחוניים והעצירים המנהליים הפלסטינים הכלואים בבתי הכלא הישראלים.

חברי הוועד סבורים שלאסירים הפלסטינים יכול וצריך להיות תפקיד מרכזי בקידום תהליך השלום ובהפצת המסר שדו-קיום במזרח התיכון הוא אפשרי, אבל זאת רק אם החברה הישראלית תטה אוזן למצוקותיהם ותתקן את האפליה הממוסדת והשיטתית נגדם - אפליה הקיימת הן בשלב השיפוטי, הן בתנאי המאסר והן בקיצובי העונש.

חברי הוועד נמצאים בקשר עם מספר לא מבוטל של אסירים פלסטינים ותיקים, שנאסרו עוד לפני הסכמי אוסלו, ושמאמינים היום בפתרון של שלום לסכסוך הישראלי - פלסטיני.

לפיכך,

חברי הוועד שמו להם למטרה:

לפעול לשינוי הנורמה שהשתרשה בועדות השחרורים שלא לשחרר אסירים ותיקים, המסווגים כאסירים ביטחוניים, שסיימו לרצות שני-שלישים מעונשם;
לפעול לקיצוב עונשם של אסירים ותיקים ובמיוחד כאלו שממשלת ישראל מסרבת לדון בעניינם עם הרשות הפלסטינית (כגון אסירים בעלי אזרחות ישראלית);
לקדם שיח ציבורי בחברה הישראלית בנוגע לבעיית האסירים הפלסטינים ולהעלות את המודעות הציבורית לעניינם;
לפעול למען שיפור תנאי הכליאה של האסירים המסווגים כביטחוניים ולהשוות את מעמדם ותנאיהם לאלה של האסירים האחרים.

כדי להשיג את היעדים האלה, הוועד פועל ויפעל הן במישור הציבורי והן במישור המשפטי. בשנה הראשונה לפעילותו, בכוונת הועד לייצג מספר אסירים ביטחוניים פלסטינים המרצים למעלה מחמש-עשרה שנות מאסר. הוועד יבקש בשמם קציבת עונש וייצג אותם בועדות השחרורים. בנוסף, הוועד מתכוון ליזום פעילות ציבורית נרחבת שתכלול כתיבת מאמרים בעיתונות וקיומו של כנס אחד לפחות במסגרת אקדמית.

על-מנת לקיים את הפעילות האמורה, לוועד נדרשים מקורות מימון. חלק גדול מהפעילות נעשה בהתנדבות אך ההוצאות הכרוכות בייצוג וניהול מערכות משפטיות מחייבות גיוס משאבים. ענייניו המשפטיים של הוועד מיוצגים על-ידי עו"ד מיכאל ספרד מתל-אביב.

اللجنة من أجل السجناء والمعتقلين الفلسطينيين

اللجنة هي تنظيم إسرائيلي يؤمن بأنه لا يمكن تحقيق السلام بين إسرائيل والفلسطينيين بدون إيجاد الحل لمشكلة الآف المعتقلين الإداريين والأسرى المصنفين "أمنيين" في السجون الإسرائيلية.
يرى أعضاء اللجنة أنه كان، ويجب أن يكون، للأسرى والمعتقلين الفلسطينيين دور مركزي في عملية السلام وفي نشر قيم التعايش في الشرق الأوسط ولكن الأمر لن يتم دون وعي المحتمع الإسرائيلي قضية الأسرى، معاناتهم وأوضاعهم وأن يعمل هذا المجتمع على إصلاح الإجحاف والتمييز المتجذر والممنهج في مؤسساته ضد هؤلاء الأسرى والمعتقلين، هذا التمييز الذي يبدأ في مراحل المحاكمة مروراً بشروط الحياة في السجن ووصولاً إلى تحديد الأحكام المؤبدة.
أعضاء اللجنة على صلة بعدد كبير من الأسرى القدماء الذين إعتقلوا قبل إتفاقيات أوسلو والذين يؤمنون بالسلام لحل الصراع الإسرائيلي الفلسطيني.
وعليه، فإن أعضاء اللجنة يسعون إلى:
ü العمل على تغيير النهج الذي تجذر في محاكم الثلث والذي "ينص" على عدم تحرير الأسرى القدماء المصنفين تصنيفاً "أمنياً" والذين أنهوا ثلثي المدة في السجن.
ü العمل على تحديد أحكام الأسرى القدماء وتحديداً أولئك الذين يحملون الجنسية الإسرائيلية حيث ترفض الحكومة الإسرائيلية النظر في قضيتهم في إطار المفاوضات مع السلطة الفلسطينية.
ü العمل على تطوير خطاب جماهيري في المجتمع الإسرائيلي يخص الأسرى الفلسطينيين ويرفع مستوى الوعي لقضيتهم.
ü العمل على تغيير ظروف إحتجاز الأسرى المصنفين تصنيفاً أمنياً ومساواة ظروفهم بظروف السجناء الآخرين.
من أجل تحقيق هذه الأهداف فإن عمل اللجنة سوف ينحصر في مستويين: جماهيري وقضائي. في عامها الأول سوف تعمل اللجنة على تمثيل بعض الأسرى الفلسطينيين، الذين قضوا حتى الآن أكثر من 15 عاماً في السجن. تمثيلهم سوف يتركز بطلب تحديد أحكامهم المؤبدة وتمثيلهم في لجان الثلث. إضافة لذلك سوف تقوم اللجنة بنشاطات جماهيرية واسعة تشمل مقالات في الصحف وتشمل عقد مؤتمر واحد على الأقل في إطار أكاديمي.
من أجل القيام بهذه النشاطات تحتاج اللجنة إلى دعم مالي. ومع أن قسم كبير من هذه النشاطات يتم بشكل تطوعي إلا أن المصروفات المتعلقة بالتمثيل القضائي تتطلب تجنيد موارد. الجانب القضائي في عمل اللجنة يقوم به المحامي ميخائيل سفارد من تل-أبيب.
