Un projet de résolution des Nations Unies affirme les droits des Palestiniens à l’auto-détermination

Un comité préparatoire des Nations Unies a approuvé un projet de résolution affirmant le droit des Palestiniens à l’auto-détermination, qui sera soumis au vote de l’Assemblée Générale de cette organisation internationale. Le texte est le suivant :

« L’Assemblée Générale ,

Convaincue que le développement de relations amicales entre les nations, fondées sur le respect du principe de droits égaux et de l’auto-détermination des peuples, est l’un des principes et l’un des objectifs des Nations Unies, tels que définis par la Charte.

Rappelant, dans cette perspective, sa résolution 2625 (XXV) du 24 octobre 1970 intitulée « Déclaration des Principes du Doit International concernant les Relations Amicales et la Coopération entre les Etats en accord avec la Charte des Nations Unies »,

Gardant à l’esprit les Conventions Internationales sur les Droits de l’Homme, la Déclaration Universelle des Droits de l’Homme, la Déclaration sur la Reconnaissance de l’Indépendance des Pays et des Peuples Colonisés et la Déclaration et le Programme d’Action de Vienne adoptée par la Conférence Mondiale sur les Droits de l’Homme le 25 juin 1973,

Rappelant la Déclaration à l’Occasion du Cinquantième Anniversaire des Nations Unies,

Rappelant la Déclaration des Nations Unies pour le Millénaire,

Rappelant en outre l’opinion consultative rendue le 09 juillet 2004 par la Cour Internationale de Justice sur les Conséquences Légales de la Construction d’un Mur dans les Territoires Palestiniens Occupés, et prenant note en particulier de la réponse de la Cour, comportant le droit des peuples à l’auto-détermination, qui est un droit erga omnes,

Rappelant la conclusion de la Cour, dans son opinion consultative du 09 juillet 2004, que la construction du mur par Israël, la puissance occupante, dans les Territoires Palestiniens Occupés, y compris Jérusalem Est, en même temps que des mesures prises auparavant, constitue un obstacle grave au droit du peuple Palestinien à l’auto-détermination.

Exprimant le besoin urgent de la reprise de négociations relatives au processus de paix au Proche Orient sur les bases acceptées et pour la réalisation d’un accord de paix juste, durable, et de large étendue entre les parties Israéliennes et Palestiniennes,

Affirmant le droit de tous les Etats de la région de vivre en paix dans des frontières internationales reconnues,

1. Réaffirme le droit du peuple Palestinien à l’auto-détermination, y compris le droit à son Etat de Palestine indépendant ;

2. Exhorte tous les Etats et toutes les agences spécialisées et organismes du système des Nations Unies à continuer à soutenir et à aider le peuple Palestinien dans la réalisation rapide de son droit à l’auto-détermination. »

UN draft resolution affirms Palestinian right to self-determination

Date : 23 / 11 / 2008 Time : 12:15 Bethlehem - Ma’an - A planning committee within the United Nations (UN) approved a draft resolution affirming Palestinians’ right to self-determination to be voted on in the international body’s General Assembly meeting. The text is as follows :

"The General Assembly,

"Aware that the development of friendly relations among nations, based on respect for the principle of equal rights and self-determination of peoples, is among the purposes and principles of the United Nations, as defined in the Charter,

"Recalling, in this regard, its resolution 2625 (XXV) of 24 October 1970 entitled ’Declaration on Principles of International Law concerning Friendly Relations and Cooperation among States in accordance with the Charter of the United Nations,’

"Bearing in mind the International Covenants on Human Rights, the Universal Declaration of Human Rights, the Declaration on the Granting of Independence to Colonial Countries and Peoples and the Vienna Declaration and Programme of Action adopted at the World Conference on Human Rights on 25 June 1993,

"Recalling the Declaration on the Occasion of the Fiftieth Anniversary of the United Nations,

"Recalling also the United Nations Millennium Declaration,

"Recalling further the advisory opinion rendered on 9 July 2004 by the International Court of Justice on the Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory, and noting in particular the reply of the Court, including on the right of peoples to self-determination, which is a right erga omnes,

"Recalling the conclusion of the Court, in its advisory opinion of 9 July 2004, that the construction of the wall by Israel, the occupying Power, in the Occupied Palestinian Territory, including East Jerusalem, along with measures previously taken, severely impedes the right of the Palestinian people to self-determination,

"Expressing the urgent need for the resumption of negotiations within the Middle East peace process on its agreed basis and for the speedy achievement of a just, lasting and comprehensive peace settlement between the Palestinian and Israeli sides,

"Stressing the need for respect for and preservation of the territorial unity, contiguity and integrity of all of the Occupied Palestinian Territory, including East Jerusalem,

"Affirming the right of all States in the region to live in peace within secure and internationally recognized borders,

"1. Reaffirms the right of the Palestinian people to self-determination, including the right to their independent State of Palestine ;

"2. Urges all States and the specialized agencies and organizations of the United Nations system to continue to support and assist the Palestinian people in the early realization of their right to self-determination."
